Some leftist legal scholars argue that the U.S. legal system is biased because “the rich guys always win.”[7] Let’s pretend that the wealthy are in complete control of the U.S. courts and could ensure victory in every case. Would the rich always want to win? If the rich always won, no one would ever trust them because they could renege on any deal. Because fairly administered contract law allows parties to avoid prisoners’ dilemma, the rich would actually be worse off if others thought that wealth would always prevail.
