Legal Issues

Just the same as with its terrestrial broadcasts, KPIG must report its Internet playlists to the appropriate collection societies. BMI and ASCAP receive a report for every song played each fiscal quarter. Other societies, such as SESAC, haven't really figured out how to calculate online usage for their members. (Certain obviously incorrect calculations sorted out to figures higher than terrestrial broadcast use, even as high as six times greater.) Collection societies have different rules for online and traditional broadcast use, and currently it's unclear how to calculate these different usage fees and even whom to pay.

KPIG's staff also uses a policy of self regulation regarding publishing playlists that predates and is actually more restrictive than the DMCA rulings. By abiding to its own stricter code KPIG doesn't have to worry about altering its terrestrial broadcast content prior to streaming.
