Final Advice


There are two types of an antitrust practice: civil practice and a criminal practice with a government agency as the opponent . When dealing with government agencies, the most important tip I can offer is to be absolutely candid with them. Tell them the answers to their questions or tell them that for whatever reason, you cannot answer their questions. It is critical to maintain the trust and confidence of agency officials beyond the current situation because you will have to deal with those same people on numerous other occasions for the same or different clients over the course of many years . The private antitrust cases brought on the civil side vastly outnumber the government cases. With regard to those cases, I have always tried to maintain basically the same policy of candor. As a result, I have had very few problems with opposing lawyers , which has given my clients a distinct advantage in litigation.

A well-known trial lawyer, Curt Frisbie has more than 30 years of trial experience. He handles major antitrust and other commercial litigation matters such as securities fraud, shareholder derivative actions, and patent, trademark and copyright cases. He has substantial experience defending class action cases. Mr. Frisbie also advises businesses on pricing plans, distributor agreements and antitrust corporate compliance programs.

Mr. Frisbie is admitted to practice before the United States Supreme Court, United States Court of Appeals for the 5th, 8th, 10th and 11th Circuits, the United States District Courts of Texas, Northern District of Georgia, and Eastern District of Wisconsin, and the Texas Supreme Court. He received his J.D. from St. Mary's University School of Law in 1971 and his B.S. from the University of Alabama in 1966.
