7.14 Ownership Policy

The policy probably should state the following. This will protect the company against theft of its hardware and software, and make clear the concept that in return for his salary, an employee is giving up any rights to the equipment he uses or software or data that he creates.

All equipment, software, and all that the employee has created on company equipment or on company time is the property of the company (or agency). No equipment shall be removed from the company premises without written authorization. No software or data should be disclosed to anyone outside the company without authorization and with authorization only to further the company's interests.

I have seen employees and even consultants make copies of their software that they developed for one client (under work made for hire) and sell it to another, not even understanding that they have committed theft and breach of contract. Making it clear in the policy reduces the likelihood of this happening and certainly provides the basis for legal action later if it is needed.


The next section helps to protect the company against lawsuits from employees placing pirated software on its systems. Also, it discourages insecure unevaluated software from being placed on vulnerable company systems.

No unauthorized, improperly licensed, or illegal software or data may be placed or allowed on company equipment or on company property.
