Don’ts

  1. Don’t expect employees to train themselves. Instead, educate employees about the whats, whys, and hows of your IM and e-mail policies. Make employees aware of their risks, rights, responsibilities, and the repercussions they will face for violating IM or e-mail policies.

  2. Don’t create separate policies for executives or managers. Instead, establish organizationwide IM and e-mail policies, and insist that officers, executives, managers, supervisors, full-time staff, part-timers, interns, freelancers, subcontractors, telecommuters, suppliers, clients, business partners—anyone associated with the organization—adhere to them.

  3. Don’t forget your international associates. If you engage in business or operate facilities abroad, have your lawyer and compliance officer ensure that your IM and e-mail rules and policies adhere to the laws and regulations of the countries in which you operate. Some European countries, for example, do not allow employers to monitor employees’ computer use.

  4. Don’t assign one individual the responsibility of single-handedly enforcing your organization’s IM and e-mail policies. Instead, establish an e-risk management team, and make all managers and supervisors aware of the important role they play when it comes to monitoring employees’ electronic behavior. Assign specific monitoring and enforcement roles to legal, compliance, human resources, and IT professionals.

  5. Don’t allow employees to dismiss the organization’s IM and e-mail policies as insignificant or unenforceable. Instead, make sure employees understand their online activity will be monitored. Stress the fact that policy violators will face disciplinary action that may include termination. Let employees know you mean business by enforcing your IM and e-mail policies swiftly and consistently.
